NOTICE TO BIDDERS Irondale Water Storage Tank Rehabilitation Project

OWNER: Borough of Wharton, 10 Robert Street, Wharton, NJ 07885, Morris County, New Jersey

DESCRIPTION: The Project will include all work necessary for rehabilitating the Borough’s existing Irondale Water Storage Tank located at 57 West Sterling Street, Wharton, NJ 07885. The work will include complete removal and replacement of the interior and exterior coating systems, including necessary measures for lead containment and abatement when recoating the tank exterior. In addition, the work will include installation of an active cathodic protection system and submersible mixing system including electrical conduits and wiring, controls, panels, and supports. Other structure improvements to be incorporated include removal and replacement of the existing shell ladder and ladder guard, and roof ladder and handrails, and installation of a secondary shell access hatch, and tank vent. Site improvements including removal and replacement of the existing chain-link security fence, excavation around the tank foundation, installation of a curtain drain, and foundation grout repair and sealing will also be included. The work will also incorporate electrical upgrades to the existing meter vault electrical enclosure to include installation of a level display, generator transfer switch with generator plug, and integration of equipment relays into the Borough's existing SCADA system. The work will also include restoration of all disturbed items.

PRE-BID MEETING: A Pre-Bid Meeting will be held at 9:00 A.M. on Wednesday June 26, 2024, at the Wharton Recreation Building located Robert Street Park (address 55 W Stirling Street, Wharton, NJ 07885). Bidders will be escorted to the tank site. Bidders are strongly encouraged to attend and participate; all bidders must sign in. No bid documents will be available at the pre-bid meeting.

EXAMINATION OF CONTRACT DOCUMENTS: Contract Documents may be examined Monday through Friday, except legal holidays, from 8:30 am to 4:00 pm at the office of the Engineer, CHA Consulting, 1639 Route 10 East, Ste 103, Parsippany, NJ 07054.

OBTAINING CONTRACT DOCUMENTS: Contract Documents may be obtained, electronically only, at no cost, by contacting the Engineer at cborinski@chasolutions.com or 973-805-6082. Contractors that obtain Contract Documents from a source other than the Issuing Office must notify the Issuing Office in order to be placed on the official Plan Holders List, receive Addenda and other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders list will not be accepted.

BID SUBMISSION PROCEDURES: Bids must be submitted on the Bid Forms contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the outside with the name of the project and the name and address of the bidder. The bid must be delivered to the Owner prior to bid opening at the above address. Bids will not be accepted after Wednesday July 10, 2024, at 10:30 A.M.

PUBLIC BID OPENING AND READING: Bids will be opened and read aloud on Wednesday July 10, 2024, at 10:30 A.M. in the Council Chambers of the Wharton Municipal Building, 10 Robert Street, Wharton, NJ 07885

BID SECURITY: Bid Security is required in an amount of not less than ten percent (10%) of the total amount of the Bid, but not in excess of Twenty-thousand Dollars ($20,000.00) as set forth in N.J.S.A. 40A:11-21.

CONSENT OF SURETY: Certificate from a Surety Company is required indicating consent to be bound as surety and grantor for performance required under the Contract Documents.

CONTRACTOR REGISTRATION:  Bidders are required to be registered by the New Jersey Department of Labor at the time bids will be received by the owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c.91, N.J.S.A. 34:11-56.51).

STATUTORY REQUIREMENTS:  Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the requirements of P.L. 1975, c. 127(NJAC 17:27) (Affirmative Action) and P.L. 1963, c. 150 (Prevailing Wage) and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et. Seq.). Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq.

REJECTION OF BIDS:  The Borough of Wharton reserves the right to reject any or all bids, or to waive any bid defect where such defect is not detrimental to the best interest of the Borough of Wharton and fairness of the bidding process.  The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents. One of the sources of funding for this project is the Federal American Rescue Plan Act of 2021 (ARPA) – State and Local Fiscal Recovery Funds (SLFRF), and adherence to all applicable federal, state and local laws is required. Therefore, all federal prevailing wage regulations as well as the Federal Labor Standards Provisions will apply. Attention is called to the fact that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their age, race, creed, color, national origin, ancestry, marital status, sex, affectional or sexual orientation and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be rewarded to business concerns owned by area residents. Small, Minority and Women’s Business Enterprises are encouraged to submit bids.

Wage determinations established under the Davis-Bacon Act will apply to this contract. Davis-Bacon requires payment of prevailing wages on federal funded projects and applies to each federal government contract in excess of $2,000 for construction, alteration, or repair of public buildings or works. NJ law requires contractors pay the higher of state prevailing wages or Davis-Bacon, for each class of worker.

Performance and payment bonds must be obtained from companies listed in OMB Circular 570 http://www.fms.treas.gov/c570/c570_a-z.html#n. A performance bond on the part of the contractor for 100% of the contract price. A payment bond on the part of the contractor for 100% of the contract price.

Wharton is located between Routes 15, 46 and 80, stretching south from the main entrance of Picatinny Arsenal, a major army research and development center, to Route 46 abounded on the west by Roxbury Township and the east by Dover and Rockaway Township. The Borough is approximately 2.2 square miles.
