NOTICE TO BIDDERS is hereby given that sealed Bids are invited and will be received as set forth herein.

PROJECT TITLE: Improvements to East Sterling Street

GENERAL DESCRIPTION OF PROJECT: This project entails the replacement of curbs and sidewalks, installation of new curbs, installation of new crosswalk markings, and the milling and resurfacing of the roadways.

EXAMINATION OF CONTRACT DOCUMENTS:

Contract Documents may be examined Monday through Friday, except legal holiday, from 9:00AM to 4:00PM, only at the office of the Engineer at the address set forth above.

OBTAINING CONTRACT DOCUMENTS:

Contract Documents may be obtained only from the office of the Engineer at the address and hours set forth above upon payment of Seventy-five dollars ($75.00) for each set of Contract Documents. All refunds shall be forwarded in strict compliance with N.J.S.A. 40A:11-24(b).

BID SECURITY:

Bid Security is required in an amount of not less than ten percent (10%) of the total amount of the Bid, but not in excess of Twenty Thousand Dollars ($20,000.00) as set forth in N.J.S.A. 40A:11-21

CONSENT OF SURETY:

Certificate from a Surety Company is required indicating consent to be bound as surety and guarantor for performance required under the Contract Documents.

BID SUBMISSION PROCEDURES:

Bids must be submitted on the Bid Form contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the outside with the name of project and the name and address of the Bidder. The Bid must be delivered to the Owner prior to Bid opening at the above address for submitting Bids. Bids will not be accepted after 10:30 AM, September 19, 2019.

CONTRACTOR REGISTRATION:

Bidders are required to be registered by the New Jersey Department of Labor at the time bids will be received by the Project Owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c. 91, N.J.S.A. 34:11-56.51). Effective September 1, 2004, Bidders are also required to be registered by the New Jersey Department of Treasury, Division of Revenue at the time bids will be received by the Project owner pursuant to the Business Registration Act (P.L.2004, c.57, N.J.S.A.52:32-44)..

STATUTORY REQUIREMENTS:

Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the requirements of N.J.S.A. 10:5-31, et seq. & N.J.A.C. 17:27-1.1, et seq. (Affirmative Action); P.L. 1963, c. 150 (Prevailing Wage); Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et seq.); and P.L.2004, c.19 & P.L.2005, c.271 (Pay to Play). In addition, effective August 1, 2005, P.L. 2005, c.67 authorized a new form of change order called “Value Engineering Construction Change Orders.” Please review these specifications to determine if this bid will involve this new form of change order for contracts that are estimated to exceed $5,000,000.00.

REJECTION OF BIDS:

The Borough of Wharton reserves the right to reject any or all Bids, or to waive any Bid defect where such defect is not detrimental to the best interest of Borough of Wharton and fairness of the bidding process. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents.

MORRIS COUNTY COMMUNITY DEVELOPMENT PROGRAM REQUIREMENTS:

Funding for this project is provided by the United States Department of Housing and Urban Development to the County of Morris. Therefore, the Federal Labor Standards Provisions and Davis Bacon wage rates and reporting will apply. Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not discriminated against because of their age, race, creed, color, national origin, ancestry, marital status, sex, affectional or sexual orientation and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority and Women's Business Enterprises, and Section 3 businesses (contracts over $100,000) are encouraged to submit bids.

NOTICE TO BIDDERS

The Borough of Wharton invites sealed bids for:

 

Contract # 2019-01– CRACK SEALER MELTER APPLICATOR

NOTICE IS HEREBY GIVEN that sealed bids will be opened and read in public for consideration by the Borough of Wharton, 10 Robert Street, New Jersey 07885 on Tuesday, October 1, 2019 at 10:00 a.m. prevailing time. All bids shall be received at the Borough of Wharton Clerk’s Office in the Municipal Building any time prior to 9:45 a.m. Thereafter (9:45 a.m. - 10:00 a.m.) a representative of the Borough Clerk’s office will be present in the Borough Municipal Building lobby and will receive bids at such place. Bids arriving after 10:00 a.m. will not be accepted.

All bids shall be presented to the Borough of Wharton by parties bidding or their agents previous to the time designated, or when called for by the Borough of Wharton.

Specifications may be obtained from the Borough Clerk between the hours of 8:30 a.m. to 4:00 p.m. Monday through Friday.

Bids shall be made on the standard proposal form and be enclosed in a sealed envelope addressed to the Borough Administrator at the above address. The name and address for the bidder and the name of the item must be printed on the face of the envelope. Bids will be rejected if not submitted within time, date and at place designated.

In all cases, in which a bid is delivered by public or private mailing, or hand delivered, the following address and notation shall appear prominently on the front of the outside envelope:

Bidders who elect to utilize public or private mailing for delivery of bid assume the burden of correctly addressing the envelope.

The Borough Council reserves the right to reject any and all bids for the above listed contract in whole and/or in part which do not comply with the specification and/or the statutory requirements. The Borough Council reserves the right to waive informalities as the Borough may deem to be in its best interest.

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 and N.J.A.C. 17:27 et seq.

All Contract documents are to be submitted intact, that is: Bidder Information, Technical Information, Proposal and Contract are part of the Contract Documents and are to be returned intact, properly assembled. All erasures, interpolations, and other physical changes in the bid form shall be signed or initialed by the bidder.

Wharton is a community of approximately 6,500 residents in the highlands of Morris County. Wharton is located between Routes 15, 46 and 80, stretching south from the main entrance of Picatinny Arsenal, a major army research and development center, to Route 46 abounded on the west by Roxbury Township and the east by Dover and Rockaway Township. The Borough is approximately 2.2 square miles.
